1. Introduction & Scope

These Course-Specific Terms and Conditions (“Course Terms”) govern your enrolment in, access to, and completion of any digital e-learning course offered by Deep Academy (hereinafter “we”, “us”, “our”).

These Course Terms apply in addition to our general Terms and Conditions and Privacy Policy. In the event of a conflict, these Course Terms shall prevail regarding matters relating to your specific course enrolment, assessments, and certification.

By clicking “Enrol Now”“Start Course”, or by accessing any course materials, you explicitly agree to be bound by these Course Terms.


2. Course Content & Curriculum

2.1. Curriculum Accuracy: We make every reasonable effort to ensure that the course curriculum, video lectures, reading materials, and quiz content are accurate, up-to-date, and relevant to industry standards.
2.2. Updates & Revisions: We reserve the right to update, revise, or replace any portion of the course content without prior notice to reflect changes in UK law, industry best practices, or technological advancements.
2.3. Supplementary Materials: Any downloadable resources (e.g., PDF guides, case studies, templates) provided during the course are for your personal, educational use only. You may not redistribute, resell, or share these resources with third parties.


3. Course Enrollment & Access

3.1. Instant Access: Upon successful payment, you will be granted immediate access to the course materials via our Learning Management System (LMS).
3.2. Access Duration:

  • One-Time Purchases: You will have access to the course for a period of 12 months from the date of enrolment, unless otherwise explicitly stated on the specific course landing page.
  • Subscription-Based Access: If you are enrolled via a monthly subscription, you will retain access for as long as your recurring payment remains active and successful.
    3.3. Suspension of Access: If you fail to log into your account or access the course for a continuous period of 180 days, we reserve the right to archive your account. You may request reactivation by contacting support, but we cannot guarantee that your course progress data will be recoverable after 180 days of inactivity.

4. Academic Integrity & Code of Conduct

Deep Academy is committed to maintaining the highest standards of academic honesty. By enrolling, you agree to the following:

4.1. No Cheating: You must complete all quizzes, exams, and assignments entirely on your own, without external assistance. The use of AI chatbots (e.g., ChatGPT, Claude) to generate answers to graded assessments is strictly prohibited.
4.2. No Plagiarism: Any written assignments, essays, or case study submissions must be your original work. Plagiarism (copying from other students, websites, or published materials without proper citation) will result in immediate failure of the assignment.
4.3. No Collusion: You must not share quiz answers or exam questions with other students, either on social media, private messaging apps, or public forums.
4.4. Proctored Exams: For specific high-stakes courses (e.g., Health & Social Care, Law), we may require you to take proctored exams using webcam monitoring and screen-sharing software. You must consent to this monitoring as a condition of certification.

Consequences of Breach:
If we suspect or confirm any violation of academic integrity:

  • Your assignment or exam will be voided with a score of 0%.
  • Your course access may be suspended pending an investigation.
  • If the breach is confirmed, your enrollment will be terminated, and no refund will be issued. You will be permanently banned from re-enrolling in any Deep Academy courses.

5. Assessment & Grading Criteria

5.1. Passing Score: To successfully complete a course and qualify for certification, you must achieve a minimum passing score of 80% on the final assessment or examination (as specified in the course syllabus).
5.2. Assessment Formats: Assessments may include:

  • Multiple-choice quizzes
  • True/False questions
  • Case study analysis
  • Written essays
  • Practical simulations (e.g., IT lab exercises)
    5.3. Re-attempts:
  • You are entitled to three (3) attempts at the final assessment.
  • If you fail on the third attempt, you will be required to re-enrol and repurchase the course at full price to obtain another attempt.
  • There are no limits on practice quizzes (non-graded) within the course modules.
    5.4. Appeals: If you believe an assessment was graded unfairly, you may submit a formal appeal to support@deepacademy.co.uk within 14 days of receiving your grade. We will review the appeal and provide a final decision within 10 business days.

6. Certification & Accreditation

6.1. Award of Certificate: Upon successfully passing the final assessment and completing all course modules, you will be issued a digital certificate via email. Physical, printed certificates are available upon request for an additional shipping and handling fee.
6.2. CPD Accreditation: Our courses are accredited by the CPD Certification Service (UK). This means our certificates contribute to Continuing Professional Development hours and are recognized by UK professional bodies.
6.3. Certificate Validity: The certificate will include your full name, course title, date of completion, and a unique verification QR code that employers or UKVI (UK Visas and Immigration) can scan to verify authenticity.
6.4. Correction of Certificates: If there is a typographical error on your certificate (e.g., misspelled name), please notify us within 30 days of issuance. Corrections made after 30 days will incur an administrative fee of £25.
6.5. Revocation of Certificates: We reserve the right to revoke any certificate if we discover that it was obtained through fraud, cheating, plagiarism, or any violation of these Course Terms. In such cases, your certificate will be permanently invalidated, and your account will be terminated.


7. Intellectual Property Rights (Course Materials)

7.1. Ownership: All course content, including but not limited to video lectures, slide decks, quizzes, downloadable resources, and software scripts, is the exclusive intellectual property of Deep Academy or our licensed instructors or Partners.
7.2. Permitted Use: You are granted a non-exclusive, non-transferable, revocable license to access the course content for your personal, educational use only.
7.3. Prohibited Actions: You expressly agree NOT to:

  • Download, screen-record, or duplicate course videos for offline distribution.
  • Share your login credentials with any third party.
  • Sell, resell, or sublicense any course content.
  • Reverse-engineer or modify our LMS software.
    7.4. Course Completion Certificate: The design and layout of our certificate are our proprietary intellectual property. You may not reproduce, alter, or forge our certificates for any purpose.

8. Course-Specific Disclaimers

8.1. Health & Social Care: Our courses provide theoretical knowledge and CPD-accredited training. They do not qualify you as a registered nurse, doctor, or social worker. You must still meet the requirements of the Nursing and Midwifery Council (NMC) or the Health and Care Professions Council (HCPC) to practice in the UK.
8.2. Law Courses: Our law courses provide legal knowledge and CPD points. They do not qualify you as a solicitor or barrister. You must complete the Legal Practice Course (LPC) or SQE and be called to the Bar to practice law in the UK.
8.3. IT & Digital Marketing: Our courses equip you with industry-relevant skills. They do not guarantee employment, promotions, or specific salary increases.
8.4. Teaching Courses: Our teaching courses provide CPD-accredited training for teaching assistants and support staff. They do not replace the Qualified Teacher Status (QTS) required to teach in UK state schools.

8.5 Accounting Courses, Construction Courses and Every other Courses not mentioned all Provide CPD – Accredited training and do not replace Higher Institutions of learning offered qualifications.


9. Refunds & Cancellations (Course-Specific)

9.1. 14-Day Cooling-Off Period: Under UK Consumer Contracts Regulations 2013, you have a statutory right to cancel your purchase within 14 days of enrolment.
9.2. Waiver of Right (Immediate Access): By checking the box during checkout (i.e., “I agree to immediate access to digital content”), you explicitly consent to us beginning the course immediately. Consequently, you waive your 14-day cancellation right once you have:

  • Viewed any video lecture in the course, OR
  • Downloaded any course resource, OR
  • Accessed the first module.
    9.3. Refund Eligibility:
  • Full Refund: You are eligible for a full refund if you request it within 14 days of purchase AND you have not accessed more than 10% of the course content (i.e., you have only viewed the introductory welcome video).
  • Partial Refund: If you have accessed more than 10% but less than 50% of the course content, we may, at our sole discretion, offer a 50% refund.
  • No Refund: No refunds will be issued if you have accessed more than 50% of the course content, or if the 14-day cooling-off period has elapsed.
    9.4. How to Request: Email support@deepacademy.co.uk with your order number and reason. Refunds are processed to the original payment method within 14 business days.

10. Student Support & Communication

10.1. Support Channels: You can reach our student support team via:

  • In-platform ticketing system
    10.2. Response Times: We aim to respond to all queries within 24 hours during business days. Urgent queries regarding exam access will be prioritized.
    10.3. Proctoring Support: If you face technical issues during a proctored exam, you must contact support immediately while the exam is ongoing. We cannot reset exams retrospectively if you do not report issues during the exam window.

11. Limitation of Liability (Course-Specific)

11.1. Educational Outcomes: Deep Academy provides educational content and CPD-accredited certification. We do not guarantee:

  • That you will secure a specific job, promotion, or salary.
  • That your visa application to the UK will be approved.
  • That your professional regulatory body (e.g., NMC, HCPC) will accept our certificate as equivalent to their requirements.
    11.2. Maximum Liability: To the maximum extent permitted by UK law, our total liability for any claim arising from your course enrollment (including but not limited to missed assessments, technical errors, or certification delays) shall not exceed the total amount you paid to us for that specific course.
    11.3. Technical Issues: We are not liable for technical failures on your end (e.g., unstable internet connection, outdated browser, power outages) that prevent you from completing assessments or accessing course materials.

12. Termination of Enrollment

We reserve the right to terminate your enrollment immediately without notice and without refund in the following circumstances:

  • You violate the Academic Integrity policy (cheating, plagiarism, collusion).
  • You share your login credentials or course materials with unauthorized third parties.
  • You post offensive, discriminatory, or harassing content in our student forums.
  • We suspect fraudulent payment or identity theft.

Upon termination, all course access will be revoked immediately, and your certificate (if already issued) will be invalidated.


13. Governing Law & Dispute Resolution

13.1. Governing Law: These Course Terms are governed by and construed in accordance with the laws of England and Wales.
13.2. Dispute Resolution:

  • We encourage you to contact our support team first to resolve any issues informally.
  • If a dispute remains unresolved, you may refer it to the UK Online Dispute Resolution (ODR) platform (ec.europa.eu/odr).
  • Ultimately, the courts of England and Wales shall have exclusive jurisdiction over any legal proceedings.

14. Changes to Course Terms

We may update these Course Terms from time to time to reflect changes in UK education regulations, accreditation standards, or our business practices.

  • Significant changes will be notified to you via email at least 14 days in advance.
  • Your continued enrollment in the course after the effective date constitutes acceptance of the updated Terms.
